The Four-Fold Test looks at who:
- Hires the worker
- Pays the wages
- Can discipline/fire the worker
- Controls how the work gets done (this matters most)
The Economic Reality Test considers:
- Is the work central to the business?
- Who owns the tools and equipment?
- Can the worker make profits or suffer losses?
- How much skill and independence is involved?
- How permanent is the relationship?
The Multi-Factor Test uses both approaches together.
A call center agent required to work fixed shifts, follow scripts, and use company equipment is an employee.
A freelance web developer who works for multiple companies, sets their own rates, works from home (using their own computer), sets their own hours, and completes projects on their own schedule is a contractor.
Implications:

While businesses face DOLE compliance orders, administrative penalties, backpay requirements, and costly litigation.
