Navigating the BIR Tax Assessment: A Survival Guide for Ordinary Filipinos

One day, you’re awakened by a knock on the door. When you open it, a man in a black suit is standing in front of you.

He’s holding a folder and says, “Good morning. I’m from the BIR.”

Suddenly, you feel nervous. Your heart starts racing. What could he want? Have you done something wrong?

That’s how most of us feel when we hear the words “tax assessment”.

But did you know that you have rights? That there’s a process the BIR must follow?

Let’s talk about how you can understand and protect yourself in this process.

Because in the world of taxation, knowledge is power.

Let’s look at Aling Nena.

She has a grocery store in town.

One day, someone from the BIR arrives.

Oh no! Aling Nena gets nervous.

“Ma’am, this is a Letter of Authority,” says the BIR representative.

“May we inspect your books?”

This is the start of the “tax assessment process”.

The Letter of Authority is important.

Without it, the BIR can’t inspect.

It’s like a policeman without a warrant – that’s not allowed!

After the inspection, if they find something wrong, they’ll give Aling Nena a “Notice of Discrepancy”.

They have a discussion. And it’s like a quiz – Aling Nena needs to respond within 30 days.

If the BIR is still not satisfied, they’ll give Aling Nena a “Preliminary Assessment Notice” or PAN. Aling Nena has 15 days to respond to this.

If it’s still not okay, next comes the “Final Assessment Notice” or FAN [Formal Letter of Demand and Final Assessment Notices (FLD/FAN)].

This is Aling Nena’s last chance to explain.

She has 30 days to “protest”.

A “protest” is like saying “Wait a minute! You’re wrong!” to the BIR.

You can ask for “reconsideration” or “reinvestigation”.

“Reconsideration” is like saying “Please look at my papers again, sir.”

“Reinvestigation” is like saying “I have new evidence. Please take a look, sir.”

It’s important for Aling Nena to be careful in her responses.

If not, the assessment might become “final and executory”.

This means she’ll have to pay even if she doesn’t agree.

That’s why it’s important to know our rights when it comes to taxes. Paying taxes may not be fun, but we need it.

Just remember:

  1. Letter of Authority before inspection
  2. Response deadlines:
    • Notice of Discrepancy: 30 days
    • Preliminary Assessment Notice: 15 days
    • Final Assessment Notice: 30 days
    • If protesting – Request for Reinvestigation: 60 days for new evidence
