Remember that you must be conducting contact tracing.
Not only for your customers and visitors of your establishment but more so for your team members.
You see, this is required by Joint Memorandum Circular No. 20-04-A, Series of 2020.
Under this Memorandum…
Employers are mandated conduct contact tracing to identify close contacts, mandating the provision of RT-PCR tests, and the submission of regular reposts.
Now, if you have a team member (i.e., employee) who tested positive for Covid-19…
First, you must observe Transparency.
Meaning…
You need a privacy notice that states that you’ll be collecting data of your employees for the purpose of contact tracing.
Second, you must observe the principle of proportionality.
Meaning…
Your contact tracing efforts would be limited to the other team members and staff who was in contact with him.
Because if you’d also include the person’s spouse, children or parents…
That would be excessive and beyond the scope of your functions as an agent of the Local Government.
Third, the contact tracing must be for a legitimate purpose.
Meaning, you have an obligation to conduct contact tracing founded in law and the same is of vital interest.
Lastly, remember that whether you have digital contactless forms or printed paper forms…
You must treat them with utmost confidentiality…
